The second amendment in no way, shape or form applies to the Zimmermann case. It should have never even been considered let alone applied. It was murder, premeditated and should have ended there with Zimmerman being found guilty. The same twisted logic is being applied to suppress protests on college campuses by one person feeling "unsafe" to suppress a majority.

The second amendment only applies to foreign invaders or the government at the federal or state level becoming tyrannical. It does not even allude to individual rights to commit murder or self defense. The "justice system" is not a "justice system" any longer. It is a system being used to justify criminal activity for the political economic and corporate system.

The first amendment gives the people the right to protest for a redress of grievances which has been taken away as can clearly be seen by the current actions of the government at the state and federal level. The people's "grievances" are being completely ignored by our elected officials. Our rights to protest and freedom of speech have been taken away. The right to declare bankruptcy has been taken away. The right to an attorney has been taken away. If declared a terrorist which has no clear definition ALL rights are taken away. Murder of an unarmed teenager however is considered self defense.

A true militia does not currently exist in the US. A militia is comprised of non military citizens in an individual state. The national guard is a part of the federal armed forces and not a true militia. This was something that was impossible to foreee when the constitution was written 250 years ago as are many other things in todays society.

If one reads the declaration of independence the majority of reasons for separation from England are present today and many are far worse. The problem is not in the constitution, it's in the failure of the government to update the constitution as well as the bogus reinterpretation of the constitution with the Zimmermann case being a prime example. Nowhere does it say in the constitution that a permit is needed to protest. It is a gauranteed right under the Bill of Rights. Yet universities are suppressing that constitutional right by saying that protestors must abide by university rules to protest. If the university puts a sign up "Keep off the grass" one can be arrested for criminal trespassing. Our "rights" have been taken away by reinterpretation of the constitution.

When the constitution was written it was never envisioned that a federal id would be instituted and yet even in that era one could have been issued. Yet today we have one called The RealID and it is required to obtain a job, vote, drivers license etc.

If we were to say "It's a sad day for democracy in America." what day would that be? Today? Yesterday? A century ago? It has been slowly eroded by the passage of time. My opinion is that the death blow came with the implementation of the Patriot Act. Something that Obama, a constitutional scholar failed to repeal and in fact supported and used against Edward Snowden. Now, today is a sad day for the world at large because of America. Either Americans are going to have to implement the changes internally or the changes will come externally from other countries. It would be far better from within for all.

Aya,

Thank you for the timely reminder. The struggle for a “free state” is a fact and Americans have long been an example to follow AND ignore. Defense of liberty is tough in any State if the rule of “law” favors the lawless who control all of the courts, the flow of money, the regulation of wealth, and all resources. The US is still struggling with its stated purpose at its founding and the clash that has created with a stark realty:

that those founders by and large, did not intend to give up their privilege and power to others that they deemed as inferior and based their economy on the tyranny of various incarnations of slavery, chattel and economic. This, of course, was a fatal flaw that eventually incited a civil war, and ended with the outlawing of chattel slavery, but sanctioned economic slavery in all of its incarnations and subsequent consequences.

Every few generations The US gets a new stream of immigrants who have infused the economy with labor and capital that is increasingly siphoned off by the autocratic owners of capital. All of which creates a government that stands in sharp contrast to any principle of liberty or freedom. The populace is acutely aware of this contradiction. They have bravely fought back at every turn and succeeded admirably against that system at many turns of history. However the judiciary, legislative, and political apparatus has been stolen from them and have been increasingly corrupted by the very people and philosophies their ancestors sought to escape. Now, as with many other nations who have shared these struggles, they are increasingly aware they must use Their First Amendment to securing speech, and The Second Amendment to protect their persons and their property from a system that is not including them in its equation of “success “: all of which creates a false narrative that this “noble experiment” is an abject failure and a lie. Those who have escaped far worse systems of government and oppression to come there, are quick to say they have secured a better life where they can be allowed to pursue their goals in life with greater success without the fear of persecution or retribution. However, as with most systems based on “free market” capitalism, they have increasingly been faced with the stark reality that this “free” system is controlled by the capitalists that have been free to pursue their goals while making it certain that those competitors (?), will not be able to compete with them, and control the economic engine that produces their wealth.

Most governments (if any at all ?), did not start with a precept that promised access to dignity, prosperity, and liberty as its foundation, and then proceeded to rule and control the very economic, legislative, and political engines that would secure those freedoms : and then deny access TO that system for others they deemed as “unworthy”. Those “unworthy” ones are beginning to get very skilled at contradicting that dominant narrative and succeeding in spite of their “betters” to own and control their own systems WITHIN the current one.

These new citizens are building a powerful and glowingly dominant culture of their very own and deemed as insignificant by their competitors: until it isn’t : and they begin to control the original system AND the culture it invented and are now replacing it with a new one. Since real freedom of ANY consequence is necessary to do this (?), then the BIG SWITCH begins to happen.

This group is very different from those who came before them, and operate by the original founding principles so vaunted by those that introduced them to the world over 2 centuries ago.

This is going to get very interesting and disruptive:

Get ready it’s going to be QUITE the RIDE.
